These Terms and Conditions apply to all bookings, photography services, products, and website use provided by Magda Greenfield Timeless Pet Photography (“the Photographer”, “we”, “us”, “our”). By booking a session or using this website, you agree to these Terms.
Australian Consumer Law
Nothing in these Terms excludes your rights under the Australian Consumer Law. You are entitled to consumer guarantees that cannot be removed or limited by agreement.
1. Bookings and Session Reservations
A booking is confirmed once the required booking fee has been received and written confirmation has been issued.
The booking fee secures your session date and allows time for preparation, planning, and administration. It is credited toward your selected package where applicable.
All bookings are subject to availability.
2. Fees and Payment
All prices are in Australian Dollars (AUD).
Unless otherwise agreed in writing:
- Booking fees are payable at the time of reservation
- Remaining balances are due on or before the session date
- Product orders must be paid in full prior to production
Prices are subject to change, however confirmed bookings will be honoured at the agreed rate.
3. Cancellations and Rescheduling
Client Rescheduling
At least 48 hours’ notice is appreciated. One reschedule is permitted without an additional fee, subject to availability. Further changes may require a new booking fee.
Client Cancellation
If a session is cancelled and not rescheduled, the booking fee may be retained to cover time reserved and preparation.
Weather and Unforeseen Circumstances
Outdoor sessions depend on safe and suitable conditions. If weather or other circumstances prevent the session from proceeding, a new date will be arranged at no additional session fee.
4. Pet Safety and Responsibility
The wellbeing of every animal is always our priority.
The Client remains responsible for the behaviour, supervision, and welfare of their pet during the session.
Clients must disclose any behavioural concerns, anxiety, medical conditions, or handling requirements prior to the session.
Pets must remain on lead in public spaces unless it is safe, legal, and agreed otherwise.
The Photographer may pause or end a session if an animal becomes distressed or conditions are unsafe.
5. Artistic Style and Session Experience
By booking, the Client acknowledges familiarity with the Photographer’s style and portfolio.
All image selection, editing, and final gallery curation are completed in line with the Photographer’s artistic vision and professional judgement.
Every effort is made to create beautiful imagery; however, outcomes may be influenced by animal behaviour, weather, light, and environment.
6. Image Delivery
Final edited images are delivered via a secure online gallery platform such as Pixieset or similar service.
Estimated delivery time is generally 2–4 weeks, with longer turnaround possible during peak periods.
Delivery is considered complete once gallery access has been provided to the Client’s nominated email address.
7. Gallery Access and Storage
Online galleries are typically available for 3 months.
Clients are responsible for downloading and securely backing up their images during this period.
While care is taken with image handling, long-term storage cannot be guaranteed.
RAW or unedited files are not provided.
8. Prints and Products
All printed products are custom-made to order.
Slight variations in colour may occur between screen display and final printed work due to differences in calibration and materials.
Production begins once payment and final selections are confirmed.
Due to the bespoke nature of products, change-of-mind returns are not available, subject to Australian Consumer Law.
9. Copyright and Usage Rights
All images remain the copyright of Magda Greenfield Timeless Pet Photography under the Copyright Act 1968.
Clients receive a personal-use licence only, which includes:
- personal printing
- sharing with family and friends
- personal social media use
Images may not be sold, edited, entered into competitions, or used commercially without written permission.
10. Privacy and Promotional Use
Personal information is managed in accordance with our Privacy Policy and applicable Australian privacy legislation.
With permission, selected images may be used for portfolio, website, social media, and promotional purposes.
If you prefer your images remain private, please notify us in writing before your session.
11. Website Use
All website content, including images, text, and branding, remains the property of Magda Greenfield Timeless Pet Photography unless otherwise stated.
Content may not be copied, reproduced, or used without written permission.
Third-party platforms linked on this website operate independently, and we are not responsible for their content or privacy practices.
12. Limitation of Liability
To the extent permitted by law, liability for loss arising from equipment failure, illness, accident, data loss, or circumstances beyond reasonable control is limited to rescheduling, re-performance of services, refund, or another fair and appropriate remedy.
Nothing in these Terms limits rights that cannot legally be excluded.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of the courts of New South Wales.
